CGT calculation
We calculate the capital gain on the transfer from your personal name to the limited company - using the current market value, original purchase price, allowable costs, and any available reliefs.
Transferring property from your personal name into a limited company is one of the most significant financial decisions a landlord can make. It triggers CGT, involves legal conveyancing, and needs to be done right to avoid unexpected tax bills.
WHO THIS IS FOR
Landlords who own property in their personal name and want to transfer it into a limited company structure. The tax case for doing it often makes sense on paper - but the transfer itself is a disposal for CGT purposes, and if the numbers are not run carefully before you proceed, the upfront cost can outweigh the long-term benefit. We handle the tax side and work alongside your solicitor to get it done.
DISCOVER WHAT HAPPENS NEXT
We calculate the capital gain on the transfer from your personal name to the limited company - using the current market value, original purchase price, allowable costs, and any available reliefs.
We handle the HMRC reporting for the disposal - including the 60-day CGT report where required and the declaration in your Self Assessment for the tax year of transfer.
We work directly with your solicitor throughout the conveyancing process - providing the tax figures they need, reviewing documents, and making sure the legal transfer and the tax treatment align correctly.
The property is in the company. Your CGT is reported and filed. You have a clear record of the acquisition cost in the company for future disposals and annual accounts.
WHAT'S INCLUDED
A transfer to your own company is not a gift - it is treated as a sale at market value for CGT purposes. We calculate the gain based on the current open market value, the original purchase price, any allowable improvement costs, and identify whether any reliefs apply such as incorporation relief or SDLT considerations.
UK residential property disposals must be reported to HMRC within 60 days of completion. We handle this filing on your behalf and ensure the gain is also correctly declared in your annual Self Assessment for the tax year in which the transfer took place.
The legal conveyancing and the tax treatment need to be coordinated carefully - particularly around the transfer price, the date of disposal, and what is recorded in the title deeds. We communicate directly with your solicitor so that the documents reflect the correct figures and there are no inconsistencies between the legal and tax records.
Once transferred, the company acquires the property at the market value used in the CGT calculation. We document this clearly so that when the company comes to sell the property in future, or when the annual accounts are prepared, the correct acquisition cost is on record and there is no ambiguity about the base for future gains.
